SIU clears officer of wrongdoing after man taken down in Newmarket

The province's Special Investigations Unit (SIU) has cleared York Regional Police of any criminal offence in relation to an arrest last June in which a man was injured after being tripped and taken down by an officer.

Police were called to an apartment building in Newmarket June 14 after a woman said her 43-year-old ex-boyfriend was in violation of the terms of his release on bail, which stated that he not communicate with her or be within a certain distance. The man was located by police in the parking lot of a nearby restaurant, less than 100 metres away from the entrance to the woman's building.

A conversation occurred between the officers and the man, the SIU said in a news release, and the officers ended up grabbing the man's arms. A struggle ensued and the man resisted being handcuffed. 

The officer on the left side of the man tripped him while holding onto his left arm and forced him to the ground. He sustained injuries to his left arm and leg, including a dislocated shoulder and fractured knee, and was handcuffed on the ground, according to the SIU. 

The SIU investigated the incident, as required by its mandate to examine officer-involved deaths or injuries. SIU director Joseph Martino said he has not found any unlawful actions on the part of the officer in this case and there is no basis for criminal charges.
