No grounds to charge officer after suspect suffers broken nose: SIU

On the night of Aug. 15, 2019, a York Regional Police officer was on patrol in Markham when he observed a 37-year-old man whom he knew to be wanted on several arrest warrants. The officer placed the man under arrest, during the course of which the man sustained a broken nose.

The director of the Special Investigations Unit, Joseph Martino, has determined that there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s injury.

The SIU is an arm’s length agency that investigates reports involving police where there has been death, serious injury or allegations of sexual assault. Under the Police Services Act, the Director of the SIU must:
    •    consider whether an officer has committed a criminal offence  in connection with the incident under investigation
    •    depending on the evidence, lay a criminal charge against the officer if appropriate or close the file without any charges being laid
    •    report the results of any investigations to the Attorney General.
